De commissie werkte niet effectief genoeg, dossiers bleven te lang liggen en meer dan eens werd het belang van de claimanten als ondergeschikt aan het algemeen belang gezien. In 2021 bracht een werkgroep onder leiding van voormalig advocaat en D66-coryfee Jacob Kohnstamm een evaluatierapport uit. Belangrijkste aanbeveling: houd meer rekening met het belang van de rechthebbenden.

De aangewezen persoon voor de uitvoering van die aanbeveling was Jacob Kohnstamm zelf. Zijn benoeming kreeg bijval: eindelijk zou er verandering komen in de stroperige, terughoudende werkwijze van de commissie. Kohnstamm ging vanaf zijn aanstelling eind september 2021 voortvarend te werk. Zijn benoeming was in principe voor drie jaar, met een mogelijkheid tot verlenging. In die korte periode bracht hij als voorzitter samen met vicevoorzitter Els Swaab veel tot stand. Claimanten voelden zich gehoord en dossiers die jarenlang stof hadden liggen vergaren, konden na juridisch getouwtrek eindelijk worden gesloten.

De verantwoordelijke staatssecretaris, Gunay Uslu, benoemde Dick Oostinga als plaatsvervangend voorzitter na het vertrek van Kohnstamm. Jurist en oud-notaris Dick Oostinga is al sinds 2018 lid van de Restitutiecommissie, die uit zeven leden bestaat. Hij was dat dus al in een tijd waarin de Restitutiecommissie niet best functioneerde. Daags na het persbericht bleken Kohnstamm en Swaab al van de website van de Restitutiecommissie verwijderd.

Pijn in het hart

Op sociale media sprak het NIW zich uit over de vreemde gang van zaken. Oostinga nam naar aanleiding daarvan contact op met de redactie. Hij wilde een en ander toelichten, maar over de ware toedracht van het ontslag zou niet worden gesproken. Een interview behoorde bij nader inzien niet tot de opties. Oostinga beperkte zich tot een omslachtige mededeling: “Omwille van zorgvuldigheid kunnen wij niet ingaan op de interne aangelegenheid die aanleiding was voor het vertrek van twee leden. Ik wil benadrukken dat de commissie eendrachtig is over de koers om op dezelfde voet met dezelfde regels en dezelfde intenties door te gaan. Met name de claimanten willen we hierover geruststellen.”

Ook Jacob Kohnstamm blijft zwijgzaam is over de reden van zijn vertrek. Wel ontzenuwt hij een aantal geruchten die inmiddels de ronde doen. Met klem benadrukt hij dat er geen sprake is van een onderling confl ict tussen hem en Swaab: “Els en ik zitten volledig op één lijn.” Van fi nanciële malversaties is evenmin sprake. “In het belang van de voortgang van de restitutie is het beter als we niets over het waarom zeggen. Maar u mag weten dat ik dit besluit met onwaarschijnlijk veel pijn in het hart heb genomen. Ik had die drie jaar heel graag af willen maken. De beleidslijn zal intern in ieder geval intact blijven, daar steek ik mijn handen voor in het vuur. Over de geruchten die nu de ronde doen, kan ik maar één ding zeggen: wie met modder gooit, verliest de grond.”

Hoe het ook zij, de gang van zaken getuigt niet bepaald van transparantie of de ‘nieuwe bestuurscultuur’ waarmee Den Haag zo graag schermt.

Geen rol

Op vragen van het NIW antwoordt het ministerie: “Wij begrijpen de zorgen die zijn ontstaan. De inzet van de staatssecretaris blijft erop gericht dat de Restitutiecommissie haar belangrijke werk voort kan zetten. Er zijn geen plannen vanuit het ministerie het ingezette beleid te veranderen. De interne aangelegenheid betreft geen inhoudelijke kwestie. De heer Kohnstamm en mevrouw Swaab hebben zelf besloten hun ontslag in te dienen, daar heeft het ministerie van OCW geen rol in gehad. Daarom past het ons niet meer te zeggen over hun beweegredenen.”

Een centrale figuur in restitutiezaken is voormalig CIDI-directeur en ex-CJO-voorzitter Ronny Naftaniel. Hoewel hij niet meer betrokken is bij het CJO, bemoeit hij zich wel nog steeds met het dossier restitutie. De vacature van Kohnstamm komt nu vrij, is hij geïnteresseerd? “Ik ben niet gevraagd en op een advertentie zal ik niet reageren.” Maar een duidelijk ‘nee’ spreekt hij niet uit. “Ik zou dan eerst moeten weten hoeveel tijd ermee gemoeid is en alle ins en outs willen weten,” antwoordt hij desgevraagd.

The State Secretary responsible, Gunay Uslu, appointed Dick Oostinga as deputy chairman after Kohnstamm's departure. Pain in the heart

Oostinga limited himself to a cumbersome announcement: "For the sake of diligence, we cannot comment on the internal matter that prompted the departure of two members. I want to emphasize that the committee is united on the course to continue on the same footing with the same rules and the same intentions. In particular, we want to reassure claimants about this."

Jacob Kohnstamm also remains silent about the reason for his departure. He does refute a number of rumors that have been circulating. He emphatically emphasizes that there is no mutual confl ict between him and Swaab: "Els and I are completely on the same page." Nor is there any question of financial malpractice. "In the interest of proceeding with the restitution, it is better if we say nothing about why. But you may know that I made this decision with improbable pain in my heart. I would have liked very much to have finished those three years. In any case, the policy line will remain intact internally, I put my hands on it. About the rumors circulating now, I can only say one thing: he who throws mud, loses the ground."

Be that as it may, the course of events does not exactly testify to transparency or the "new administrative culture" that The Hague is so fond of displaying.

No role

In response to questions from the NIW, the ministry replied, "We understand the concerns that have arisen. The State Secretary's commitment remains focused on ensuring that the Restitutions Committee can continue its important work. There are no plans from the Ministry to change the policy that has been initiated. The internal matter does not concern a substantive issue. Mr. Kohnstamm and Ms. Swaab made their own decision to resign; the Ministry of OCW had no role in this. Therefore, it is not appropriate for us to say more about their motives."

A central figure in restitution cases is former CIDI director and ex-CJO chairman Ronny Naftaniel. Although he is no longer involved with the CJO, he still interferes with the restitution file. Kohnstamm's vacancy is now vacant - is he interested? "I have not been asked and to an advertisement I will not respond," he says. But he doesn't pronounce a definite "no. "I would then first have to know how much time is involved and want to know all the ins and outs," he replies when asked.
