Among the arguments are that the defendants are not immune from suit, the claims are not pre-empted and should not be dismissed on grounds of comity, that the US courts are a proper forum and that the claims are timely. As regards the US courts being a proper forum, the plaintiffs assert that the Limbach Commission lacks both legal and moral authority which the defendants claimed for it, and that the fact that the President of the SPK, Hermann Parzinger, had called for its reform showed that the Commission could not provide adequate recourse for the heirs of persecutees.To read the filing, click here.
